.net and .com question

two sites are the same domain names. just different extension.

My site has the .NET, and another has the .COM.

I will probably launch my site first (2 weeks?). The other guy is planning to launch his around february 06.

what r the legal issues behind this? can two similar site with similar services exist?

or is this a lawsuit in the making scenario?

to my knowledge, unless you've bought both the .net and .com websites, there isn't much u can do. unless your nike, and have the money to back up, you'll probably won't be able to get a lot done

Are the contents exactly the same? If yes, that obviously infringes the copyright law.

Otherwise, there should not be any problem. The other webmaster who owns the .com domain with the exact same spelling can have a similar website as yours and be perfectly legal.

To answer your question, two similar sites with similar service can exists without any legal issues.

But if trademarks, copyright infringement, and Nike (company with $$) were involved, legal proceedings can take place.

well, the .com (which I don't own) hasn't launched yet. Not sure if they will or not, or when. I plan to launch mine in about 2 weeks. I wonder if first mover advantage will work in my favor if the time comes.

And yes, it will likely have the same content, same business model.

It is legal still. The content needs to be original though, thus not infringing other writer's copyright.

There really is not much you can do about it. How do you know if that individual will have a similar site as you simply based on the domain?

If the URL contains a trademarked, then it is infringing, doesn't matter who launched it first. So, if other company's business name is: "Joes CDs" and they launch www.joescds.com and you launch www.joescds.net you could have it legally taken away.
