Are the contents exactly the same? If yes, that obviously infringes the copyright law.
Otherwise, there should not be any problem. The other webmaster who owns the .com domain with the exact same spelling can have a similar website as yours and be perfectly legal.
To answer your question, two similar sites with similar service can exists without any legal issues.
But if trademarks, copyright infringement, and Nike (company with $$) were involved, legal proceedings can take place.
